Dropped Cases Tutorial
What is a Dropped Case?
Law offices refer patients to us, but sometimes cases don’t proceed as planned. This can happen when a case lacks strength, the patient’s insurance doesn’t cover expenses, or the patient decides not to move forward with the law firm. In such instances, the law office may drop the case.
Common Reasons for Dropped Cases:
- Insufficient Evidence – Not enough proof to show responsibility.
- New Evidence – New information that weakens the original case.
- Witness Problems – Key witnesses are unavailable, change their story, or refuse to testify.
- Procedural Errors – Mistakes during the legal process can undermine the case.
- Unlawful Evidence – Improperly collected evidence that can’t be used in court.
- Lack of Public Interest – The case is not deemed important enough to pursue.
Steps to Follow After a Case is Dropped:
- Notify via Slack: Post the dropped case letter in the Slack channel and notify Candace and the person responsible for handling those cases.
- Update Practice Fusion: Document the case as dropped in the system. If the patient has an upcoming appointment, cancel it and inform the supervisor and the patient, particularly for in-person visits to avoid unnecessary costs.
- Log the Case in the Tracker: Add the patient’s details to our case tracker. The tracker will be shared after the video.
- Provider-Specific Records: Log the dropped case in the appropriate "Dropped Letters" Google Sheet, organized by the doctor who treated the patient.
- Contact the Patient: Inform the patient that their law firm is no longer representing them. This ensures they’re aware if they’re seeking a new attorney. Always document these conversations in the notes.
- Follow-up Attempts: Attempt to contact the patient five times, two attempts per day. If no response is received after five business days, pause for a month before trying again. After the second attempt, if still no response, mark the case as lost.
- Weekly Report: At the end of each week, email Candace to confirm that all dropped cases are organized and updated.
